Bergen County Family Law

Family law in New Jersey encompasses a broad range of legal issues the involve the family in some manner. Bergen County Custody Disputes

The laws governing custody disputes can be found in New Jersey Statutes Title 9. The State of New Jersey, through its legislature, declared the public policy of the State to have both parents involved in child rearing and to allow children to have contact with their parents when the parents have separated in contemplation of divorce or after divorce. Title 9: 2-4 lists numerous factors courts must consider when determining custody arrangements. The court’s ruling requires an analysis of the listed factors in resolving the custody dispute guided by the principle that any ruling made by the judge must be in the best interest of the children. Custody may be joint physical and legal, joint legal but sole physical custody with parenting time for the non-custodial parent, or some other living arrangement with a guardian.

Bergen County Child Support Orders

Judges determine child support orders based upon calculations under New Jersey’s child support guidelines. The non-custodial parent pays child support to the custodial parent. Both parents are liable to financially support their children. Therefore, New Jersey’s child support guidelines seek to strike a balance between the amount of time a child spends with each parent and the non-custodial parent’s financial situation. The guidelines take into consideration whether physical custody of the children is sole or shared. New Jersey law defines sole custody as the child spending less than 104 nights a year, which is essentially every weekend, with the non-custodial parent. Next, the court looks at various economic factors including gross income from whatever source earned by the non-custodial parent. The non-custodial parent is additionally obligated to provide health insurance benefits to their children in most situations. Judges can modify child support orders if circumstances have changed for either parent.

Bergen County Divorces

A married person can file for divorce in New Jersey by alleging either at-fault grounds such as adultery, desertion, imprisonment, or bigamy, among others. A party can file for dissolution of a marriage based on no-fault grounds known as irreconcilable differences under Title 2A:34-2. A judge can grant a divorce based on irreconcilable differences when the parties have lived separately for six months, and the judge finds that there is no hope of reconciliation. As part of their divorce, the parties can agree on how to distribute the marital property and the marital debts.
