In New Jersey, there are a couple of ways that an individual may be charged with DWI. The first is a “per se” law. Someone who drives with a blood alcohol concentration of 0.08% or higher is guilty of driving while intoxicated. If you have consumed more than one drink per hour, it is quite possible that your blood alcohol concentration will exceed this legal limit.

Law enforcement officers will observe your behavior while driving and subsequently in a field sobriety test. For example, were you swerving while driving? Did you disregard traffic signals? Did you have trouble walking or following instructions during a field sobriety test? The officer may use these observations to arrest you for DWI.

Officers are trained to monitor drivers for signs of intoxication. Specifically, they look for:

  • Bloodshot eyes
  • Slurred speech
  • The smell of alcohol
  • Mental state
  • Signs of disorientation or a lack of coordination

However, breathalyzer machines and field sobriety tests are not perfect, and mistakes do happen. If evidence is not obtained properly, it may be tossed out of court. New Jersey has a system of graduated penalties in place—as the level of intoxication or number of previous DWI convictions increase, penalties for the current charge become more severe. Consulting an attorney as early as possible is essential to protecting your rights.
