What is Driving While Intoxicated in New Jersey?
Most drivers are familiar with the number .08% – a driver whose blood or breath alcohol concentration is greater than 0.08% is presumed to be driving while intoxicated. This alcohol concentration can be measured by a test of the driver’s blood or breath conducted if law enforcement officers have reason to believe the driver is operating a vehicle under the influence of alcohol. However, you may also be found to be driving while intoxicated under New Jersey Revised Statutes Section 39:4-50 if:
- You are under the influence of a narcotic, hallucinogenic, or habit-forming drug and as a result are unable to safely operate a vehicle;
- You are under the influence of an intoxicating liquor and as a result are not able to safely operate a vehicle;
- You knowingly permit another person who is under the influence of an intoxicating liquor and/or narcotic, hallucinogenic, or habit-forming drug to operate your vehicle.
Thus, even if your breath or blood alcohol concentration is below 0.08%, you may still face the serious consequences of a DWI conviction.
