This purpose of this is so that each side can have a fair understanding of the facts and evidence the other side intends to present at trial.
  • Litigation: If the parties are still unable to resolve their claims, the last phase will involve the litigation of the claim before a judge or jury. The judge or jury will determine the facts of the case and render a verdict for one party or the other. The party who “loses” at trial can appeal the verdict if he or she believes errors occurred.
