  • Discovery: Once the pleading stage is complete, the parties to the lawsuit – you (the plaintiff) and the alleged at-fault motorist (the defendant) will depose witnesses, exchange reports from expert witnesses, and disclose other evidence and witness statements to one another in advance of trial. This purpose of this is so that each side can have a fair understanding of the facts and evidence the other side intends to present at trial.
  • Litigation: If the parties are still unable to resolve their claims, the last phase will involve the litigation of the claim before a judge or jury. The judge or jury will determine the facts of the case and render a verdict for one party or the other. The party who “loses” at trial can appeal the verdict if he or she believes errors occurred.
