We’re definitely treading on unchartered territory when it comes to the social networking site Twitter. Last week, we talked abut tweets that could land you in prison. And now we’re back to tell you the news doesn’t get any better when it comes to your tweeting teen.

The truth is that there are so many ways that he or she could get in trouble. First of all, teenagers often lack the maturity to restrain from making inappropriate comments or to think about the long-term consequences of what they’re tweeting. Not to mention that kids as young as seven are increasingly accessing social media.

A threatening tweet can be considered a crime

Tweeting is protected under the First Amendment freedom of speech rights, but there are exceptions, especially when security is at stake.

An Alabama man is awaiting sentencing next month after pleading guilty to threatening to kill President Obama in a series of messages he sent out over the social networking site Twitter that referenced an anti-government militia group.  Jarvis Britton wasn’t found to have any connections to the militia group and he apologized for “acting stupid” in sending out the tweets, but he now faces up to five years in prison.

You can request to have your records deleted

It goes without saying that a criminal record can ruin your chances for getting a job, a rental home or even a date. Your criminal record is a matter of public record, but there are certain instances when you may be able to get your criminal record expunged (deleted) from public files.

Supreme Court bars officers from forcing blood tests on most DUI suspects

Police officers can no longer force people suspected of driving while drunk to take a blood alcohol test without a warrant. Officers must request a search warrant with corroborating evidence if the motorist declines a blood test during a DUI stop.

legalblog1In a ruling announced earlier this week, the Supreme Court said that police officers can order a blood test from people they believe have been driving under the influence of alcohol only if they have a search warrant, except in an emergency or other unusual circumstances.  The Court found that most DUI stops did not, in and of themselves, constitute an emergency.  The decision basically upholds a person’s Fourth Amendment right against unlawful searches, which the court said includes forced blood tests.

Texting and Driving:  Do You Know What Will Happen To You?

A recent article was written to address updated laws to address the growing problem of driving and texting related accidents on the road.  New Jersey is steadily moving to become the toughest state on distracted drivers, specifically aimed at those who continue to text while driving.  As of March 21, S69 was sent to Governor Chris Christie for his approval.  

The state of New Jersey has gone as far as to adopt a law allowing “full prosecution of cell phone users if they drive recklessly and cause serious harm or death.  Penalties would include prison time and fines up to $150,000, similar to drunken driver punishments.”  Lieutenant Governor Kim Guadagno, who signed the measure in July of 2012 stated, “If you wouldn’t drink and drive you shouldn’t text and drive.”
