What Is Meant by ‘No-Fault’ Divorce in New Jersey?

No-fault divorce became law in New Jersey in 2007, and it means that the spouse seeking the divorce does not need to state a reason other than that the married couple has experienced irreconcilable differences for at least six months with no hope of reconciliation, or they have been living separately for 18 months or more.

In the past, the divorcing spouse usually had to claim adultery, desertion, or some other bad act on the part of the other spouse. However, those other grounds still exist, in addition to these:

  • Physical or mental cruelty
  • Drug/alcohol addiction
  • Institutionalization for insanity or mental illness
  • Incarceration
  • Deviant sexual behavior without plaintiff’s consent

The only other requirement for filing for divorce in New Jersey is that one of the parties must be a state resident for at least one year at the time the action is commenced. (N.J.S.A. § 2A:34)

What is the Difference Between Contested and Uncontested Divorce in New Jersey?

An uncontested divorce is when the spouse being served with the divorce papers signs and returns them without objecting to anything contained in them, including grounds and terms such as property division and shared parenting. In a contested divorce, if the spouse being served disagrees with the content of the divorce papers, they will file their own answer and counterclaim outlining their objections.
