Family Law Bergen County, NJWhen it comes to family law in New Jersey, a family law issue is handled by the Family Division of the New Jersey Superior Court, typically at the county level. The court process varies depending on the case, but we will explain how to go to family court and other information you should know.
Family Court Trial Procedure What Happens at a Family Court Trial?During the trial the Plaintiff’s attorney will call witnesses that support the Plaintiff’s position. The Plaintiff’s attorney will then examine the witness who will then be cross examined by the Defense attorney. Once the Plaintiff has rested their case, it is the Defendant’s turn to present evidence. If there is a Guardian ad Litem, he or she also participates in questioning witnesses and can also call his or her own witnesses. The Judge may also ask questions of the witnesses.
Once all the testimony and evidence are presented in court, the Judge will deliberate and make his or her ruling, in the form of a written final order or “Decree.”
