Divorce Proceedings in Hudson County

Filing for divorce in Hudson County begins with the filing of a petition for divorce in the Hudson County Superior Court, located at 595 Newark Avenue in Jersey City, New Jersey. Pursuant to New Jersey Statute 2A:34-2, a person may file for divorce based either on the existence of one or more “fault-based” grounds (like infidelity or abuse) or on the presence of “irreconcilable differences.” This statute also holds that if the spouse filing for divorce is claiming irreconcilable differences, then one spouse (either the one who is filing for divorce or the other) must have been a resident of New Jersey for at least one year.

The Many Decisions in a Hudson County Divorce Proceeding

If the court hearing your divorce case finds the divorce ought to be granted, then the court will need to enter other orders as well. These can include orders:

  • Dividing the property (personal and real, tangible and intangible) as well as the debts and obligations between the parties in a “fair and equitable” manner;
  • If the couple has any children, orders determining which parent with whom the child will primarily reside and what parenting time schedule the parents must follow; and/or
  • Requiring one spouse to pay the other spouse a certain sum of money as alimony or spousal support to assist that spouse in maintaining an appropriate level of income until such time as he or she can support him or herself independently.
