New Jersey Divorce

Although New Jersey may appear geographically small, residents who live in the Garden State experience many of the same problems as do residents in other larger, surrounding states like New York and Pennsylvania. This includes the breakdown of marriages and divorce filings – some of which may become quite heated and contentious. While obtaining a divorce has become easier in recent years, this does not mean the divorce process is easy to understand. Unfortunately, once a court enters is decree of divorce and adjudicates the legal issues between the parties, it may be to late to undo the harm caused by a bad decision. Just because you may presently reside in New Jersey does not automatically mean a New Jersey divorce is available to you in terminating your marriage. In order to be eligible for a divorce, there must be:

• A ground or reason for the divorce: Either one spouse must have done some act that harmed the other spouse (such as adultery), or the spouse filing for divorce must alleged that there has been a breakdown in the marital relationship such that continuation of the marriage relationship is not practical.
• Residency: In most cases, at least one of the parties must have been a resident of New Jersey for at least one year prior to the filing of the divorce petition (this does not apply in cases of adultery). For example, if the filing spouse lives in Pennsylvania but the other spouse has resided in New Jersey for over a year, the filing spouse may file his or her action in New Jersey. Similarly, if the filing spouse has lived in New Jersey for over a year but the other spouse recently moved to New York, the filing spouse could still file his or her divorce action in New Jersey.

If a court determines that it does not have the authority (called “jurisdiction” to hear the divorce action, the petition for divorce may be dismissed. The filing spouse could then refile the case once the requirements for filing are met and/or file for divorce in a state that has jurisdiction.
