We handle both residential and commercial closings and other related matters.
Residential TransactionsFor many people, the purchase or sale of their home is among the most important financial events of their lives. Whether you are the buyer or the seller, we will assist you throughout the process.
The buying and selling of a home involves several steps:
When the seller accepts the buyer’s offer, then a contract is drawn. Many real estate contracts are prepared by a realtor. When a New Jersey realtor drafts the contract, then state law requires a 3-day attorney review, which goes into effect upon the signing of the contract by both parties.
During this period of time, your New Jersey real estate lawyer will review the document carefully to ensure that your rights have been protected and will recommend any necessary changes, additions, or deletions.
While the contract is in attorney review, either party can rescind it. If you decide that it is in your best interests to rescind the contract, we will help you follow the specific requirements to accomplish that goal.
Only contracts crafted by a New Jersey realtor are required by New Jersey law to include a provision for attorney review. If you are not working with a New Jersey realtor, it is important that you hire an experienced New Jersey real estate lawyer to create or review your agreement before you sign. Once you do sign, the contract will be binding.
The ClosingOnce the buyer and seller have agreed to a price, the contract has gone through attorney review, the buyer has secured a mortgage commitment, the house has been inspected, and the certificate of occupancy has been granted, the final step is the closing. Your Aretsky Law Group, P.C., real estate lawyer will attend the closing and will ensure that all the necessary documents are signed and in order and that funds are distributed appropriately.
