Restraining Orders:

In New Jersey, restraining orders are legal protections intended to prevent further harm or harassment in situations involving domestic violence. There are two primary types of restraining orders in New Jersey:

  1. Temporary Restraining Orders or TROs are issued to provide immediate protection to a victim. Often times it is obtained the same day it is requested. A TRO remains in effect until a final hearing can be held, which usually takes place within ten days of the issuance of the TRO. You can seek out a temporary restraining order at a local Somerset County police station or at the Somerset County Superior Court, Family Part. If a TRO is granted, the police will serve the order on the Defendant.
  2. Final Restraining Orders or FROs are issued after a court hearing where both parties have the opportunity to present their case to the judge. It is highly recommended for both parties to have legal representation for an FRO hearing to effectively present their case and navigate the legal proceedings. If a plaintiff does not appear for the hearing then the TRO will expire. If a FRO is issued, it will include more specific terms than the TRO and will typically ban any form of contact, outline support provisions and establish custody arrangements if applicable. An FRO remains in effect until one of the parties petitions the court to alter or rescind it.
Grounds for a Restraining Order:

To obtain a restraining order in Somerset County, New Jersey, a victim must demonstrate that he or she has been subjected to one or more acts of domestic violence, which can include:

  • Assault
  • Harassment
  • Stalking
  • Sexual assault
  • Kidnapping
Process of Obtaining a Restraining Order:
  • Filing a Complaint: The victim (plaintiff) must file a complaint detailing the incidents of domestic violence.
  • Temporary Restraining Order (TRO): The victim can request a TRO from a judge, who may issue it if they believe immediate protection is necessary.
  • Final Hearing: A hearing is scheduled, typically within ten days of the TRO being issued. Both parties can present evidence and testimony.
  • Final Restraining Order (FRO): If the judge finds sufficient evidence of domestic violence, an FRO will be granted.
Importance of Legal Assistance:

Navigating the restraining order process can be complex and emotionally taxing. Having experienced legal counsel can significantly impact the outcome of the case. An attorney can help by preparing and filing the necessary documents, representing the victim or the accused in court, providing guidance on legal rights and options.
