Physical custody refers to the time each parent is permitted to physically be with the child. Legal custody refers to a parent’s decision-making rights. While joint or shared custody is preferred, child custody agreements can take several forms:

  • Sole Legal Custody - This grants one parent the authority to make all decisions related to the child's welfare, including health, religion, and education.
  • Joint or Shared Legal Custody - This gives both parents the right to make decisions about the child.
  • Joint or Shared Physical Custody - When residential custody is shared, a child spends time with both parents according to a parenting schedule.
  • Sole Physical Custody - This grants one parent total physical custody of a child. The other parent may or may not have parenting time rights.
