Annulments

Obtaining an annulment is far more difficult than obtaining a divorce. New Jersey courts tend to prefer granting divorce rather than an annulment of a marriage. At Aretsky Law Group, P.C., in Ridgewood, New Jersey, we have experience helping people obtain legal annulments of their marriages.

The state of New Jersey recognizes two types of annulments, void ab initio, meaning that the marriage is void from its inception, and a voidable annulment. A marriage can be annulled void ab initio without going to court. However, it is a good idea to have the court formally recognize the annulment. This type of marriage annulment is generally granted in circumstances where it can be shown that a marriage never happened or should have never happened. Examples would include marriages between blood relatives or marriages where one of the spouses was already married.

A voidable marriage requires one or both of the people involved to go to court. These marriage annulments may be granted in cases where one of the spouses was under the age of consent, the marriage resulted in bigamy, or in cases, where the marriage occurred as a result of intoxication, fraud, or duress.

Since divorce is less complicated than annulment, most people prefer divorce. However, we have helped people obtain marriage annulments for personal and religious reasons.
